In response to an anonymous competitive inquiry, the ERSP reviewed Garden of Life's advertising claims for fucoTHIN, currently the number one selling product in the natural products industry according to SPINSSCAN. (January 26, 2008)
Following a review of the Company's print advertising and web site, the ERSP concluded that Garden of Life provided a reasonable basis for general performance claims, stating the product is a non-stimulant that burns fat without stimulating the central nervous system, and is a dual action formula that burns fat while providing antioxidant cellular protection.

According to Ray, when the ERSP first initiated its inquiry, it raised several issues which were quickly resolved after review of the multiple studies and scientific articles Garden of Life submitted. The submissions included two human clinical studies on the proprietary fucoTHIN formula with a total of 150 participants, two animal studies demonstrating that fucoxanthin increased the metabolic process in cells, as well as several studies as support for the efficacy of fucoTHIN.
The ERSP agreed that the 150 participants in the Company's human weight loss study followed the "Gold Standard" of double-blind placebo controlled studies specifically performed on the effects of fucoTHIN on the human body. In a study of 150 overweight women, the ERSP noted that the group taking fucoTHIN lost an average of 14.5 pounds while the placebo group only lost 3 pounds. The studies lasted 16 weeks and during that time the women followed a 1,800 calorie per day diet.
During the ERSP review, Garden of Life noted that it was in the process of revising its advertising and had begun steps to modify claims of product superiority to conform to ERSP recommendations. Garden of Life agreed to refer to the results of its human clinical studies as "clinically studied" or "clinical results."
