Kaneka Corporation Announces Settlement

Kaneka Corporation filed suit against Xiamen Kingdomway Vitamin, Inc. and Pacific Rainbow International, Inc. in the United States District Court for the Central District of California, alleging infringement of U.S. Patent No. 7,145,044, which covers methods of producing reduced coenzyme Q10 (Ubiquinol) using solvents with high oxidation-protective effects. Xiamen Kingdomway Vitamin, Inc. and Pacific Rainbow International, Inc. acknowledge the validity and enforceability of the '044 Patent, but deny liability for all of the acts alleged in the lawsuit.
The parties have reached a settlement of this case, pursuant to which Kingdomway and Pacific Rainbow have agreed to discontinue their reduced coenzyme Q10 (Ubiquinol) products within the United States, and to refrain from marketing, importing, using, offering for sale or selling such products within the United States during the remaining term of U.S. Patent No. 7,145,044, which expires on September 12, 2022.

Under the terms of the agreement, other details of the settlement remain confidential.
