DES MOINES, IA -- (Feb. 9, 2005) -- Kemin today issued a statement regarding the order filed on the remaining patent issues in the litigation between Kemin and Pigmentos Vegetales del Centro S. A. de C. V. (PIVEG). The order follows a jury verdict in the case that was entered in September 2004.
The order, filed Tues., Feb. 8, 2005, by Judge James E. Gritzner in the U.S. District Court for the Southern District of Iowa, held that the two contested patents [U.S. Patents 5,382,714 (‘714) and 5,648,564 (‘564)] are both valid and enforceable. The ruling also confirmed the jury’s findings that PIVEG infringed the ‘564 patent and upheld the associated monetary damage award to Kemin.
Dr. Rodney Ausich, president of Kemin Health stated: “We are pleased with the court’s order on the patent issues. We are gratified that the jury and judge have affirmed the integrity of our intellectual property.”
