Jarrow challenges FDA hiring of Daniel Fabricant

Jarrow L. Rogovin sent Dr. Margaret Hamburg a letter strenuously opposing the FDA’s hiring of Daniel Fabricant, Ph.D., formerly a top executive at the Natural Products Association.

 

Jarrow L. Rogovin, Founder, President and Chairman of the Board of Jarrow Formulas, Inc., and Chairman of the Board of Jarrow Industries, Inc., sent Dr. Margaret Hamburg, Commissioner of the U.S. Food and Drug Administration; a letter strenuously opposing the FDA’s hiring of Daniel Fabricant, Ph.D., formerly a top executive at the Natural Products Association (NPA, previously NNFA). The letter asserts that Dr. Fabricant gained access to proprietary and confidential industry “trade secrets” and was bound to keep that information private, and as such, has a deeply rooted and irreconcilable conflict of interest in his role as the FDA’s new Director of Dietary Supplement Programs.

“Because of his past employment with the Natural Products Association (NPA) as Vice President of Scientific and Regulatory Affairs, and one year as its acting CEO, Dr. Fabricant has an insurmountable conflict of interest,” said Jarrow L. Rogovin. “This should be obvious to anyone involved in the industry including anyone at the FDA.”

Mr. Rogovin’s letter Re: FDA’s hiring of Dr. Fabricant is a prelude to Jarrow Formulas’ campaign to challenge the FDA’s “Draft Guidance for Industry: Dietary Supplements: New Dietary Ingredient Notifications and Related Issues.” Jarrow Formulas has also submitted a 16-point letter to the FDA requesting an extension to the NDI Draft Guidance comment period, from 90 days to one-year (ending July 5, 2012).
