License to Carolwood to Sell MSM Terminated According to MSM Investments

PORTLAND, OR - MSM Investments Co., LLC has terminated its license to Carolwood Corporation to sell MSM under the United States and foreign patents it holds on MSM. MSM Investments is managed by Robert Herschler, the sole inventor of the MSM patents which were licensed to Carolwood. The only companies which are now licensed under the Herschler MSM patents are Cardinal Nutrition of Vancouver, Washington, and Chemiplus, located in Japan. Only Cardinal Nutrition, Chemiplus, and their customers are authorized to make, use, sell or distribute MSM as covered by Herschler's United States and foreign patents.

The license was terminated on May 15, 2002 based on Carolwood's failure to pay royalties and its breach of a settlement agreement reached in December, 1999 which established the license. MSM Investments sued Carolwood in April 2001 in federal court in Oregon for breach of contract and other claims. That lawsuit is still pending.
