Nutratech Issues Retraction for Press Release

RE: Nutratech Settles Patent Infringement Lawsuit Against Supplier - AMAX

WAYNE, N.J., November 4, 2004 – Nutratech, Inc. – a research-based nutraceutical ingredient supplier – issued a press release two weeks ago announcing the settlement of their patent infringement action against AMAX NutraSource, Inc. (AMAX), an Oregon Corporation, in the United States District Court for the District of Oregon. As stated in that press release, this action asserted U.S. Patent Nos. 6,224,873 and 6,340,482 and was based on the sale of Citrus aurantium material for weight loss purposes. Although, Nutratech is actively pursuing suppliers who are knowingly infringing on Advantra Z’s patents, Nutratech would like to retract any inference in that press release that AMAX deliberately infringed on those patents. The lawsuit has been dismissed, and the terms of the parties’ settlement are confidential and cannot be disclosed by either party.
