[2/10/2005] Federal Court Order Finds Kemin’s two U. S. Lutein Patents Valid and Enforceable
US-based ingredient company Kemin Industries has reported that an order, filed this week in the U.S. District Court for the Southern District of Iowa, holds that the company's two contested patents [U.S. Patents 5,382,714 (‘714) and 5,648,564 (‘564)] are both valid and enforceable. The order follows a jury verdict from September last year, in the litigation between Kemin and Pigmentos Vegetales del Centro S. A. de C. V. (PIVEG).

[2/9/2005] Rooibos Ltd Closer to Victory in Trademark War
According to an article in South Africa's Business Report, the district court of Missouri has ruled for the plaintiff, US-based Republic of Tea, in that company's battle against Burke-Watkins over the use of the term 'rooibos' on its packaging and advertising. According to the article, Burke-Watkins purchased the trademark for $10 in June 2001 from Forever Young, a company founded by South African Annique Theron, who registered rooibos as a trademark in the US.
