Sabinsa Successfully Protects its Piperine (BioPerine) Patents

PISCATAWAY, NEW JERSEY- Sabinsa Corporation announced today that it has successfully concluded its Patent Infringement and Federal Trademark Infringement lawsuit against Nutrition Formulators Inc (NFI). A Final Judgment was entered in the United States District Court in New Jersey on January 23rd, 2004.

Sabinsa filed suit against NFI in December 2002 for infringement of the Piperine Patents #5,972,382 and #6,054,585 as well as for intentional, willful and bad faith intent to trade on the goodwill of Sabinsa's Trademark registration No.1,976,029, for BioPerine®.

The Final Judgment stipulated that the Patents and Trademark were valid and properly issued by the US Patent and Trademark Office, and that NFI was "enjoined from selling, using or importing any piperine extract for the uses and equivalents covered by the Patents". Additionally, a Judgment was entered in favor of Sabinsa and against NFI in an amount as agreed to in the Settlement Agreement signed by NFI. NFI is also obligated to cooperate with Sabinsa by providing additional documentation.

Sabinsa Corporation will continue to pursue all legal remedies available to protect its Intellectual Properties, Mr. Sysler has commented. We invest significant amounts of money each year into research and development to develop products that can be safely and confidently used by the Nutritional Supplement industry. Intellectual Property is one avenue to bring this R&D to the marketplace.
