ZMC claims Kaneka CoQ10 patent invalid

Zhejiang Medicine Company and ZMC-USA, L.L.C. has filed a complaint for a declaratory judgment in the U.S. District Court for the Southern District of Texas against Kaneka Corporation. ZMC seeks a declaration from the Court that the claims of the '340 patent are not infringed by ZMC and are invalid, unenforceable, void and of no legal consequence.

At midnight EDT on March 22, 2011, Kaneka Corporation was issued United States Patent No. 7,910,340 entitled "Process for Producing Coenzyme Q10". At 12:01 EDT, Zhejiang Medicine Company ("ZMC") and ZMC-USA, L.L.C. filed a complaint for a declaratory judgment in the U.S. District Court for the Southern District of Texas, Houston Division, against Kaneka Corporation. In their Complaint, ZMC seeks a declaration from the Court that the claims of the '340 patent are not infringed by ZMC and are invalid, unenforceable, void and of no legal consequence. It is important to note that ZMC and ZMC-USA are the only litigants in the Kaneka patent suit to have filed a declaratory judgment complaint against Kaneka prior to its filing but after the '340 patent was issued. ZMC's complaint requires Kaneka to defend the validity and enforceability of its patent. This is a test ZMC is certain Kaneka cannot meet.

The '340 patent provides that Ubiquinone ("CoQ10") is manufactured from Ubiquinol ("QH") and ZMC will demonstrate that this patent offers no improvement over existing technology and is not economically feasible on a commercial scale, rendering the patent invalid and unenforceable. CoQ10 has been commercially produced for over 30 years with Kaneka being only one of several innovators, including ZMC, during that period.
