BioCell Technology LLC, the exclusive manufacturer and supplier of the patented dietary ingredient BioCell Collagen II®, today announced it has filed a trademark infringement lawsuit in the U.S. District Court in the Central District of California against ProTec Laboratory Inc. ProTec has infringed, and continues to infringe, BioCell's trademarks by offering to sell, selling, distributing and/or advertising dietary supplements that ProTec claims contain the BioCell Collagen II® ingredient. Specifically, the complaint alleges that ProTec's actions and misrepresentations are likely to cause confusion, mistake, or to deceive the public as to the source or approval of its dietary supplements and/or ProTec's affiliation with BioCell Technology. The suit further alleges state and federal unfair competition claims and seeks permanent injunction, treble damages and disgorgement of profits, among other relief.
