BOSTON, April 15 -- ZonePerfect Nutrition Company, a Boston-based subsidiary of Abbott Laboratories and the maker of ZonePerfect(R) nutrition bars, today filed suit against Hershey Foods Corporation and Dr. Barry D. Sears, the author of diet books, to prevent them from marketing products that infringe on ZonePerfect's trademarks.
Among other things, the suit charges that Hershey's forthcoming "SmartZone" nutrition bar features a logo nearly identical to the one used on ZonePerfect(R) products. The suit, which also names the Hershey Chocolate & Confectionery Corporation, a division of Hershey, was filed in U.S. District Court in Boston.
Founded in 1996, ZonePerfect Nutrition Company markets its products through major food, drug and mass merchandisers across the United States as well as through its direct to consumer program. The brand is positioned in the center of the rapidly growing healthy living category.
