Update in Ongoing Litigation between Mineral Resources International, Inc. (MRI) and Trace Minerals Research, LC (TMR)

June 6, 2007 Ogden, UT —On January 12, 2007, TMR, LC filed a motion for partial summary judgment in the ongoing litigation between MRI and TMR. TMR’s motion requested summary judgment on a portion of TMR’s claims, including breach of contract and trademark infringement. On Friday, TMR’s motion for partial summary judgment was denied in part and granted in part.

Specifically, the U.S. District Court denied summary judgment on TMR’s request for injunctive relief, which sought to enjoin MRI’s use of the disputed trademarks in international markets, such as Canada, and on TMR’s claim that MRI exceeded the scope of its permitted use of certain trademarks under the applicable agreements. The Court also denied TMR’s request for partial summary judgment on one of MRI’s counterclaim.

The Court granted partial summary judgment in favor of TMR as to MRI’s use of the name ConcenTrace® in the U.S. market and, specifically, on MRI’s web site, but did not address MRI’s right to use that trademark in markets outside of the United States. The Court ruled that injunctive relief on this matter is moot because MRI is not listing ConcenTrace® on its web site.

A number of claims remain in this lawsuit, which MRI intends to continue to fully and vigorously pursue and defend against.
