Proprietary Nutritionals Inc. Begins Patent Infringement Lawsuit Over InoCell (TM) Product

Proprietary Nutritionals Inc. (PNI) and Abulkalam M. Shamsuddin, M.D., Ph.D., a Professor at the University of Maryland School of Medicine, have taken legal action against Vitamin Research Products (VRP), of Carson City NV, for infringement of a patent involving PNI’s InoCell™ Natural Protection (Inositol & Cal-Mag IP6). The lawsuit was filed on June 2 in the United States District Court for the District of Maryland.

In the complaint, Dr. Shamsuddin is identified as the inventor and owner of the U.S. Patent for the product now known as InoCell. PNI, headquartered in Brantford ON, is identified as the exclusive licensee for the product. The lawsuit alleges that VRP has “directly infringed and or induced the infringement of one or more of the claims of the patent issued [for InoCell] … through the manufacture, use, sale, offer to sell, marketing, distribution and/or importation of dietary supplements, including but not limited to the products called [InoCell] … throughout the United States …,” including Maryland, without the proper authorization of PNI or Dr. Shamsuddin.

Since 1999, in the defense of all companies authorized to market and sell the product, ten lawsuits have been filed against companies accused of patent infringement involving InoCell or its predecessor products. Some of the companies accused of patent infringement challenged the validity of Dr. Shamsuddin’s patent. The U.S. Patent & Trademark Office ruled in favor of the existing patent in each of those cases and all actions taken against the companies violating the patent have been successful.
